Contested Divorce in Florida

The preferred outcome during a divorce is that it is uncontested and both spouses are in agreement over the various issues that need to be dealt with.

The issues that spouses must reach an agreement on include:

  • Alimony

  • Parenting time arrangements
  • Child relocation

When there is no agreement reached, the result is a contested divorce. Generally, contested divorces last four times longer than an uncontested divorce. Each case’s time period will vary based upon how many aspects of the divorce are not contested.

Florida law requires mediation in all divorces that are scheduled for trial. This means that a judge will order the spouses to attend a mediation session with both of their attorneys, in order to attempt to resolve their disputes prior to a trial. The goal is to reach a resolution of all of the issues so that a trial can be avoided. When an agreement is not reached over one or more issues, the case will need to be decided by a judge in court.
